Acesta este orice comportament nedorit care lezeaz\u0103 demnitatea, creeaz\u0103 un mediu ostil, intimidant sau ofensator. Formele pot fi diverse:<\/p><ul><li>verbale (glume ofensatoare, aluzii, comentarii despre aspectul fizic);<\/li><li>nonverbale (gesturi, imagini, mesaje cu con\u021binut indecent);<\/li><li>ac\u021biuni fizice;<\/li><li>presiune psihologic\u0103, intimidare sistematic\u0103.<\/li><\/ul><p>Fiecare astfel de incident la locul de munc\u0103, poate constitui temei pentru <strong>o investiga\u021bie intern\u0103 privind h\u0103r\u021buirea <\/strong><strong>(harassment)<\/strong>, pentru o pl\u00e2ngere a angajatului c\u0103tre autorit\u0103\u021bile de supraveghere \u0219i pentru solicitarea compens\u0103rii <strong>prejudiciului moral<\/strong>. Ignorarea semnalelor duce inevitabil la un conflict cu legea.<\/p><p><strong>Ce riscuri suport\u0103 angajatorul?<\/strong><\/p><ul><li><strong>Verific\u0103ri din partea Inspectoratului de Stat al Muncii.<\/strong> La recep\u021bionarea unei sesiz\u0103ri privind <strong>h\u0103r\u021buirea <\/strong><strong>(harassment) <\/strong><strong>la locul de munc\u0103<\/strong>, inspectorul este obligat s\u0103 verifice respectarea normelor privind prevenirea discrimin\u0103rii. \u00cen urma controlului pot fi emise prescrip\u021bii \u0219i aplicate amenzi.<\/li><li><strong>Verific\u0103ri \u00een cadrul Consiliului pentru Egalitate.<\/strong> Dac\u0103 angajatul depune o pl\u00e2ngere la <strong>Consiliul pentru Egalitate<\/strong>, compania va trebui s\u0103 demonstreze c\u0103 toate m\u0103surile de prevenire \u0219i solu\u021bionare a h\u0103r\u021buirii (harassment) au fost luate la timp. \u00cen caz contrar, exist\u0103 riscul constat\u0103rii discrimin\u0103rii \u0219i al prejudiciului de imagine.<\/li><li><strong>R\u0103spundere penal\u0103.<\/strong> Anumite forme de h\u0103r\u021buire intr\u0103 sub inciden\u021ba <strong>articolului 173 din Codul penal al RM<\/strong>. Cazul poate ajunge p\u00e2n\u0103 la urm\u0103rirea penal\u0103 a persoanelor nemijlocit vinovate, dar \u0219i a celor cu func\u021bii de r\u0103spundere din cadrul companiei.<\/li><li><strong>Ac\u021biuni privind repararea prejudiciului moral.<\/strong> Angajatul are dreptul s\u0103 solicite \u00een instan\u021b\u0103 desp\u0103gubiri pentru suferin\u021bele cauzate prin actul de h\u0103r\u021buire (harassment).
